As a licensed behavior analyst, Hopeful Horizons, PLLC follows applicable confidentiality and record-protection requirements, including those governing the practice of behavior analysis in Texas and the professional ethical requirements applicable to Board Certified Behavior Analysts (BCBAs). Behavior analysts are ethically required to protect confidential information and to disclose it only under appropriate circumstances, such as with authorization or when otherwise required or permitted by law.

Please include the client's name, the name of the requesting individual, and the type of records being requested. Additional verification of identity or authority may be required before records are released.

Requests will be handled in accordance with applicable Texas law and professional recordkeeping requirements.
 
Texas Privacy Rights Notice

I would include the following section because TDLR specifically states that behavior analysts must prominently post this language on their website along with instructions for requesting records:

 

Texas law provides certain rights regarding privacy of and access to health care records (Texas Health & Safety Code, Chapter 181, Medical Records Privacy). To file a consumer complaint alleging a violation of your privacy rights regarding protected health information, contact the Texas Office of the Attorney General, Consumer Protection Division.
